Mobile opt-in consent data and phone numbers are never shared for any purpose.
We may share your general property information only in the following limited operational scenarios to facilitate your landscape contracting project: Service Providers (sharing necessary site data with trusted specialized subcontractors, such as licensed arborists, wholesale plant nurseries, or Massachusetts Dig Safe (811) for public utility locates prior to major earthwork); Legal Requirements (if required by law, court order, or local municipal zoning mandates); and Business Transfers (if we are involved in a merger or sale of the company). However, this explicitly excludes mobile phone numbers and SMS opt-in consent data; mobile information is never shared with any third parties under any circumstances.

J. MOSCA LANDSCAPING & DESIGN, INC. ("Company," "we," "our," or "us") provides these Terms and Conditions to govern your access to our website and our professional landscape contracting, lawn care, and garden services. By authorizing site work, signing a hardscape design proposal, scheduling routine maintenance, or using our digital client portals, you ("Client," "you," or "your") agree to be bound by these Terms and Conditions in their entirety. If you do not agree with any part of these terms, you must not utilize our landscaping services.
We provide comprehensive landscape contracting and property management services for residential and commercial clients. This includes, but is not limited to: hardscape installation (patios, walkways, retaining walls), turf management, seasonal cleanups, planting design, and New England winter snow management. The specific scope of our contracting work, heavy machinery deployed, and materials used for your property will be defined exclusively by a separate, fully executed written service agreement.
All landscape design and contracting estimates provided by our team are valid for 30 days. Final construction costs may vary if hidden subterranean conditions or undisclosed zoning restrictions are discovered during our site excavation (e.g., massive granite boulders, buried construction debris, severe root entanglement, or poor soil compaction). Any major deviations from the original landscape plan require a formal, written change order approved by the Client.
Clients are strictly responsible for funding their projects according to the payment schedule outlined in their specific contract. Deposits are generally required before our crews begin ordering bulk landscape materials (e.g., pallets of pavers, custom stonework, or sod). In accordance with state law, we reserve the right to apply a statutory mechanic's lien under Massachusetts law to the property for unpaid contracting fees, labor, or landscape materials.
The Client agrees to provide our landscaping crews, excavators, and snow management vehicles with safe, unobstructed access to the property during scheduled service hours. The Client is strictly responsible for unlocking gates, securing pets, and clearing the work area of personal property prior to our arrival for site maintenance or construction.
While we strive to adhere to estimated construction and maintenance timelines, all outdoor landscaping dates are approximate. The Company shall not be held liable for delays caused by factors beyond our reasonable control, specifically severe New England weather conditions (e.g., heavy rain, Nor'easters, or snow storms creating unsafe conditions for heavy equipment operation).
During active landscape construction or snow management operations, Clients, their children, and their guests must maintain a safe distance from our heavy machinery (skid steers, excavators, plows) and open trenches at all times. All construction equipment provided by the Company is to be operated exclusively by our trained staff.
You agree to accurately identify property lines and authorize excavation work only if you are the legal owner of the site. Crucially, the Client is responsible for disclosing the location of all private underground utilities prior to any earthwork, including invisible dog fences, private irrigation systems, and private landscape lighting wires. The Company is explicitly not responsible for damage to unmarked private subterranean lines. We will contact Massachusetts Dig Safe (811) for public utility locates as required by law prior to major excavation.
The Company maintains comprehensive professional and general liability insurance. However, to the fullest extent permitted by law, our aggregate liability arising out of any landscape contracting project is strictly limited to the direct cost of correcting our specific scope of work. We are explicitly not responsible for pre-existing structural foundation issues, damage caused by natural frost heave, or any indirect, incidental, consequential, or punitive damages.
If you voluntarily opt-in to receive text messages from us, you agree to receive automated SMS/MMS messages strictly for operational project management. Operational message examples include: "J. MOSCA LANDSCAPING: Your mowing crew will arrive in approximately 30 minutes." or "J. MOSCA LANDSCAPING: Due to today's heavy rain, your patio installation has been rescheduled to tomorrow." We do not use text messaging for marketing or promotional campaigns. Message frequency will vary based on the active phase of your project. Message and data rates may apply. You can opt-out at any time by replying STOP. Text HELP for assistance.
Your consent to receive these text messages is completely voluntary. The SMS opt-in checkboxes on our inquiry and estimate forms are explicitly non-mandatory. Opting out will not affect your ability to contract with us for your landscaping needs. We strictly protect your mobile data. We do not share, sell, rent, or trade your mobile phone number or SMS opt-in consent data with any third parties, affiliates, landscape material suppliers, or external subcontractors for any purpose.
All landscape designs, hardscape blueprints, 3D renderings, and project photography created or provided by J. MOSCA LANDSCAPING & DESIGN, INC. remain the exclusive intellectual property of the Company. These materials are provided solely for the execution of your specific project and may not be reproduced, distributed, or utilized by third-party contractors without our express written permission and final payment.
These Terms and Conditions and all landscape contracting agreements shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles. Any legal disputes arising from our services must be resolved through good faith negotiation. If litigation becomes necessary, both parties consent to the exclusive jurisdiction of the state courts located in Norfolk County, Massachusetts.
You agree to fully indemnify and hold harmless J. MOSCA LANDSCAPING & DESIGN, INC., its landscape contractors, crews, and staff from any claims, damages, or liabilities arising from your failure to secure necessary Homeowner Association (HOA) architectural approvals for our proposed hardscapes, or your failure to disclose private underground utilities. If any provision of these Terms is found by a court to be unenforceable, that specific provision shall be limited to the minimum extent necessary so that the remainder of these Terms shall remain in full legal effect.
